They protect both you as the client and Avalon Music as the service provider, ensuring a fair and predictable process from booking to performance.

This agreement covers all services provided by Avalon Music, including but not limited to talent booking, event coordination, and use of our website (avalonmusic.net). It applies to all interactions, whether they occur online, via email, or in person, and supersedes any prior oral or written agreements.

By booking our services or using our website, you confirm that you have read, understood, and agree to be bound by these Terms of Service.

Agreement Binding on Clients

This agreement becomes legally binding upon the Client’s formal engagement of our services, typically confirmed by signing a performance agreement or paying a deposit. Your engagement signifies your full acceptance of these live music terms.

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to book services with Avalon Music. By engaging our services, you represent and warrant that you meet these requirements.

Avalon Music is a premier provider of live entertainment for weddings, corporate events, galas, and private parties in the Houston area. We specialize in connecting clients with top-tier professional musicians and DJs.

Live Music and DJ Services

Our core service is providing high-quality musical talent. This includes a diverse roster of professional bands, solo instrumentalists, string ensembles, and DJs suited for any occasion. We ensure every artist is vetted for talent, professionalism, and reliability.

Event Coordination and Talent Management

Beyond booking, we offer comprehensive talent management and coordination. Our team handles all logistics, including contracts, payment processing, communication with artists, and day-of-event coordination to ensure a flawless performance. We act as the single point of contact, simplifying the process for you.

Booking and Payment Policies

Our event booking policies are designed to be straightforward and secure, ensuring a smooth process for securing your desired talent.

Deposits and Payment Schedule

A non-refundable deposit is required to secure your booking. The specific deposit amount will be outlined in your individual performance agreement. The remaining balance is typically due on a pre-arranged schedule, with the final payment required before the event date.

Cancellations and Refunds

In the event of a cancellation by the Client, the initial deposit is non-refundable. Cancellations made within a certain timeframe of the event date may require payment of the full or a partial contract balance, as detailed in your performance agreement. Refunds are generally not provided, except under specific circumstances outlined in the “Force Majeure” section.

Client Responsibilities

To ensure a successful event, we rely on a cooperative partnership with our clients. Your adherence to the following responsibilities is crucial.

Event Information Accuracy

The Client is responsible for providing complete and accurate event details, including date, time, venue address, and specific performance requirements. Any changes to this information must be communicated to Avalon Music in a timely manner.

Compliance with Venue Rules

The Client must ensure that the event venue provides a safe and appropriate environment for the musicians. This includes adequate space, protection from the elements, and access to electrical power. The Client is also responsible for ensuring the performance adheres to any venue-specific rules or sound ordinances.

Cooperation with Avalon Music Staff

We ask for your full cooperation with our staff and musicians before and during the event. Clear communication and mutual respect are essential for a smooth and successful performance.

Musician and Talent Policies

Avalon Music holds its artists to the highest standards of professionalism and performance quality.

Professional Conduct

All musicians and talent contracted by Avalon Music are expected to conduct themselves professionally at all times. This includes arriving on time, dressing appropriately for the event, and interacting courteously with the Client, guests, and other vendors.

Performance Expectations

Our artists are committed to delivering a performance that meets or exceeds the agreed-upon expectations. We work closely with you to understand your musical preferences and event timeline to create the perfect atmosphere.

Substitutions

In the rare event that a booked musician is unable to perform due to illness or emergency, Avalon Music reserves the right to provide a substitute of equal or greater talent and experience. We will notify the Client of any such change as soon as possible.

Intellectual Property

This section covers the use of Avalon Music’s copyrighted and trademarked materials.

Use of Music Samples and Media

The audio samples, videos, and photographs on the Avalon Music website are for promotional purposes only. They are the property of Avalon Music or its artists and may not be downloaded, reproduced, or used for any other purpose without express written permission.

Copyrights and Trademarks

The Avalon Music name, logo, and all related content on our website are protected by copyright and trademark laws. Unauthorized use of our intellectual property is strictly prohibited.

Limitation of Liability

This section outlines the limits of Avalon Music’s liability in connection with our services.

Damages and Claims

Avalon Music’s liability for any claim, damage, or loss arising from our services is limited to the total fees paid by the Client for the specific event in question. We are not liable for indirect, incidental, or consequential damages.

Any disputes or legal claims arising from this agreement will be subject to the exclusive jurisdiction of the courts in Harris County, Texas. Both parties agree to comply with all applicable local, state, and federal laws.
